Acceptance

These Terms of Service (“Terms”) are a binding agreement between you and Lagster (“Lagster,” “we,” “us”). By installing, accessing, or using the Lagster service, site, or client software, you agree to these Terms. If you do not agree, do not use the service.

You must be at least 16 years old to use Lagster. If you are accessing the service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

The Service

Lagster is a network-optimization service that routes game traffic through a privately operated edge network to reduce latency, packet loss, and jitter. The service includes our client software, subscription account system, and supporting infrastructure.

We may add, remove, or modify features at any time. We aim to maintain high availability, but we do not guarantee uninterrupted access. Planned maintenance and upgrades may occasionally require temporary downtime.

Account & Security

You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

Notify us immediately at support@lagster.cloud if you suspect unauthorized access.

Accounts are for individual human use. You may not share your account with others or resell access. Multi-seat plans (e.g. Duo, Squad) provide distinct licenses that may be assigned to specific users within your household or team.

You must provide accurate registration information and keep it up to date.

Subscription & Billing

Lagster is offered on a recurring subscription basis. By subscribing you authorize us (and our payment processors) to charge your payment method for the plan selected, plus any applicable taxes, on a recurring monthly or annual basis until cancelled.

If a charge fails, we may suspend or terminate access until payment is resolved. You are responsible for keeping your payment method current.

Refunds

First-time subscribers are eligible for a full refund within 7 days of their initial purchase if the service does not measurably improve their connection.

Request refunds by emailing support@lagster.cloud from the account email.

Renewal charges, upgrades, and additional licenses purchased after the first 7 days are non-refundable except where required by law.

Abuse of the refund policy (e.g. repeated refund requests after extended use) may result in forfeiture of eligibility.

Acceptable Use

You agree not to:

Use the service for any illegal activity or to violate the rights of others.

Resell, rent, sublicense, or otherwise transfer the service without our prior written consent.

Reverse engineer, decompile, or attempt to extract source code from the client software, except where such restriction is prohibited by law.

Use the service to attack, probe, or disrupt any network, system, or infrastructure (yours or anyone else's).

Circumvent account limits, licensing restrictions, or technical protections.

Interfere with other users' ability to use the service, including by abusing our infrastructure in ways that degrade performance.

Violations may result in immediate suspension or termination without refund.

Third-Party Services

Lagster routes traffic for games and applications operated by third parties. Your use of those products is governed by their own terms, EULAs, and anti-cheat policies.

While Lagster operates at the network layer and does not interact with game processes or memory, you are ultimately responsible for complying with the terms of the games you play. We make no warranty that a given publisher's policies permit use of third-party network tools in all circumstances.

Intellectual Property

The Lagster client, website, branding, documentation, and all underlying software and technology are owned by Lagster and protected by intellectual property laws.

Subject to these Terms and an active subscription, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the client software for personal, non-commercial use (or within the seat count of your plan).

You retain ownership of your account data and any content you submit. By submitting feedback or suggestions, you grant us a perpetual, royalty-free license to use them without obligation.

Disclaimers

The service is provided “as is” and “as available.”

To the fullest extent permitted by law, we disclaim all warranties, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

Network performance depends on many factors outside our control, including your ISP, your hardware, the game publisher's infrastructure, and physical distance. We do not guarantee specific latency, uptime, or performance improvements.

Limitation of Liability

To the maximum extent permitted by law, Lagster and its officers, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill arising from your use of the service.

Our total aggregate liability for any claim arising out of or relating to these Terms or the service will not exceed the greater of (a) the amount you paid us in the twelve months preceding the claim, or (b) USD $100.

Termination

You may cancel your subscription at any time from your dashboard. Cancellation takes effect at the end of the then-current billing period.

We may suspend or terminate your access at any time if you violate these Terms, if required by law, or to protect the security or integrity of the network. Upon termination, your license to use the client software immediately ends.

Sections relating to intellectual property, disclaimers, limitation of liability, and governing law survive termination.

Changes To Terms

We may update these Terms from time to time. When we do, we will update the effective date at the top of this page and, for material changes, provide reasonable notice via email or in-product notification.

Continued use of the service after changes take effect constitutes acceptance of the updated Terms. If you do not agree with a change, you may cancel your subscription before the change takes effect.

Governing Law

Lagster is a limited liability company organized under the laws of Delaware, United States. These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-law rules.

Any dispute arising from or relating to these Terms or the service shall be resolved exclusively in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of those courts — unless mandatory consumer-protection laws in your country of residence provide otherwise.
